This Software License Agreement ("Agreement") is entered into between Anton Technology ("Licensor," "we," "our," or "us") and the end user ("Licensee," "you," or "your") of the Flash software platform ("Software"). By downloading, accessing, or using the Software, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms.
Subject to the terms of this Agreement, Anton Technology hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Flash software platform.
This license is solely for your personal or internal business use in accordance with the documentation provided and the applicable subscription plan you have purchased.
The license granted herein is conditional upon your compliance with the terms of this Agreement and your subscription payments, if applicable.
You agree that you will not, and will not permit others to:
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
Copy, reproduce, modify, adapt, translate, or create derivative works based on the Software.
Distribute, sublicense, lease, rent, sell, or transfer the Software to any third party.
Remove, alter, or obscure any proprietary notices or labels on the Software.
Use the Software for any illegal purpose or in any manner that violates applicable local, state, national, or international laws.
The Software, including all intellectual property rights therein, is and remains the exclusive property of Anton Technology and its licensors.
This Agreement does not convey to you any ownership interest in the Software, but only a limited right of use that is revocable in accordance with the terms of this Agreement.
All trademarks, service marks, logos, and trade names displayed on or through the Software are the property of their respective owners.
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms.
Anton Technology may terminate this license at any time if you breach any provision of this Agreement.
Upon termination, you must cease all use of the Software and destroy all copies, full or partial, of the Software in your possession or control.
THE SOFTWARE IS PROVIDED "AS IS"AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
ANTON TECHNOLOGY DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE.
Anton Technology may, at its discretion, provide upgrades, updates, patches, and fixes for the Software. These updates may be automatic or require manual installation, and may be necessary for the continued use of the Software. This Agreement will govern any upgrades provided by Anton Technology that replace or supplement the original Software, unless such upgrade is accompanied by a separate license, in which case the terms of that license will govern.
You acknowledge that all intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Software and its content, features, and functionality are owned by Anton Technology, its licensors, or other providers of such material. This Agreement does not grant you any rights to use such intellectual property except for the limited license granted herein.
